Illinois Federal Court Denies Standing in BIPA Claim Against Google

As the use of biometric data is exploding, organizations are working to keep up with the shifting rules and case law. Active litigation under the Illinois Biometric Information Privacy Act, for example, includes recent cases regarding who has standing to bring an action under the law. An Illinois district court recently dismissed a claim against Google regarding the retention of biometric data and use of facial templates from uploaded photos. We analyze this decision, including how the court distinguished its holding from a recent California federal case finding standing on similar facts regarding Facebook’s alleged extraction of biometric identifiers from uploaded photos.
