CCPA and Online Ads: Facebook Finally Acts, AG Starts Enforcement

The California Attorney General has taken the first steps to enforce the CCPA, sending noncompliance letters to websites that his office contended needed Do Not Sell links for consumers. Ad giant Facebook has also introduced a last-minute CCPA compliance mechanism for the many brands and advertisers now shunning third-party sales of data. These developments come amidst uncertainty as to what “sale” means. In this article, the first of a two-part series, we look at the reasonable interpretations of sale under CCPA, the shift among consumer-facing companies to limit the role of vendors, and uncertainties about how the consumer opt-out will be enforced for advertising.
