CISA and DHS Counsel Explain Cybersecurity Executive Order’s Key Provisions

President Biden’s sweeping executive order on cybersecurity (EO), issued on May 12 in the wake of a series of attacks on American companies, proposes various measures to strengthen both the government and private sector’s cybersecurity, including facilitating increased information sharing, improving software security, enhancing cybersecurity standards and processes for government systems, and establishing a cyber safety review board. At a recent ABA presentation moderated by Northrop Grumman assistant general counsel Maureen Kelly, DHS Deputy General Counsel Jennifer Daskal and CISA Chief Counsel Dan Sutherland discussed the EO’s key provisions and the reasoning behind them. We distill their commentary and provide insight from our discussion with Gibson Dunn partner Alexander Southwell on the EO’s implications.
